LAST WILL AND TESTAMENT OF DANIEL H. JUDY DECEASED

Know all men by these that I Daniel H. Judy of Atlanta of Logan County Illinois being of sound and disposing mind and memory do make publish and declare this to be my last will and testament hereby revoking all former wills by me made.

First. It is my will that my executors hereinafter named pay out of my estate all my just debts and funeral expenses.

Second. My will is that all of my property real personal and mixed shall be converted into money within three years after my death and divided among my children James J. Judy, Mary A. Moorehead, Nancy E. Carlock and Jennie E. Curry share and share alike equally between them. I have heretofore given my son John H. Judy his share out of my estate as an advancement.

Third. I nominate and appoint M. P. Carlock and J. J. Judy executors of this my last will and I authorize them to contract bargain sell transfer and convey by all proper deeds and modes of conveyance all property I may own at my death and convert the same into money and divide the proceeds arising therefrom after paying my debts and costs of administration among my said children - except said John H. my said executor to have the same authority and power to convert such property into money as I might have if living - and in case of the death of either of them before completion of the trust herein imposed then the survivor shall carry out such trust - all sales to be private or public as my executors or the survivor deem best. No bond shall be required of my executors for acting as such.

In testimony whereof I have this 25th day of April AD 1894 hereunto set my hand and seal to this my last will. Signed - Daniel H. Judy. Witnesses - J L Bevan, S. B. Scott, A. E. Church.

In Probate on the 19th day of November 1897. Now on this day comes J. J. Judy and presents to the Court a petition, duly verified by affidavit, praying that an instrument of writing purporting to be the Last Will and Testament of Daniel H. Judy deceased, now on file in said Court, be admitted to Probate. It appearing to the Court from said petition that the said Daniel H. Judy died at his home in Eminence on or about the 16th day of November A. D. 1897 and at the time of his death resided at his home in the County of Logan and State of Illinois, and that the names of the heirs at law and legatees as set forth in said petition, are as follows, to-wit: James J. Judy, Mary A. Moorehead, Nancy E. Carlock, Jennie E. Curry, J. H. Judy. Which petition is filed, and it is ordered by the Court that the 3rd day of January A. D. 1898, be set for a hearing on said petition.
